48-hour IDRC program

You MUST:

1.Complete the 48 consecutive hours of detainment.

2.Complete the educational component and screening interview.

3.If required, an assessment (The criteria to determine whether as assessment is needed are as stated in Section 10:161-4.2 of the New Jersey Administrative Code (N.J.A.C). See page 2 for a summary of assessment criteria)

a.If the screening interview determines that an assessment is not needed, then you will have satisfied your legal obligation upon completion of the 48-hour detainment.
OR
b.If the screening interview determines that an assessment is needed, and you are a 1st or 2nd offender you must then:

i.Select a Provider from the IDRC Provider List.
ii.Sign the following forms:

  • “Records Release Authorization” (ALC 41)
  • “Choice of Provider” (ALC 33)
  • “Agreement to Schedule the Assessment” (ALC 40)

iii.Schedule an appointment with the Provider for an assessment (which may include alcohol and/or drug testing) within ten (10) business days.
iv.Pay the Provider’s fee at the appointment (you may qualify for state funding).
v.Follow the Provider’s recommendations.

  • If the Provider assesses you that you do not need treatment, contact the IDRC.
  • If the Provider assesses you to need treatment, you must complete the treatment (Length of treatment is determined by the Treatment provider).


If you do not comply with your DUI Legal Requirements, you will be in violation of your Court Order. Non-Compliance may result in a court appearance, additional license suspension, fines and the possibility of jail time.

NOTE: If you have been placed into non-compliance by any IDRC for any reason with the Court and/or Motor Vehicles, the con-compliance will NOT be lifted until All IDRC requirements are satisfied and your file is closed.

Upon completion of the 48-hour IDRC your file is transferred to the County IDRC who monitors your case.

Summary of Assessment Criteria

The criteria used to determine an assessment is needed as stated in N.J.A.C 10:162-4.2 includes the following:

  1. Repeat Offenses
  2. Blood Alcohol Content
  3. Answers given to the evaluation instrument
  4. Prior outpatient or inpatient treatment
  5. Prior self-help group attendance
  6. Driving record
  7. Counselor’s interview & observations
  8. Information from outside sources
  9. Age

Chapter 162, Intoxicated Driving Program, 10:162-3.7, 3rd or Subsequent DUI/Refusal Offenders with a 10-year license suspension.

The following must be completed prior to a recommendation for license restoration.

  1. The IDRC Education Class
  2. An assessment and successful completion of an IDRC Affiliated Treatment Program, if clinically determined by the agency.
  3. One year in treatment and/or self-help meetings (monitored by the IDRC) if treatment was indicated.  You must participate in treatment and/or self-help meetings for a total of one year from the beginning of treatment, if indicated.
  4. A re-evaluation with an IDRC Affiliated Treatment Provider must be completed  One year prior to your scheduled license restoration date, you must:

A. Contact the IDRC to:

  1. Review proof of your completion of all IDRC and Provider requirements to date
  2. Set-up an appointment for a re-assessment at an Affiliated Treatment Provider

B. Be re-assessed by an Affiliated Treatment Provider; results will be sent to the IDRC.

The Provider and/or IDRC may require you to complete additional treatment and/or to participate in self-help meetings prior to the IDRC making its recommendation that your license be restored.

NOTE: A multiple offender means a client with three or more lifetime intoxicated driving related offenses (DUI and/or Refusal).
